Introduction

This Privacy Policy (“Privacy Policy”) covers the collection, use, and disclosure of personal information by Digitoys Inc. and any of our corporate affiliates, including our parent, its subsidiaries, and all entities in the corporate chain (individually and collectively, “Digitoys”, “Company” "we," "us," or “our”) anytime (i) you purchase, use, own or license any of our Products, such as our Cryptoys and branded digital toys, as defined in our Terms of Service and End User License Agreement (together “Terms”) or access, use or engage any of our Services, such as our mobile applications (“App”), as defined in our Terms.

We provide various capabilities through our website located at www.cryptoys.com (“Site”), App and other technologies (together “Platforms”) that enable you to purchase, use, engage with and sell Products, as well as license, use and engage with our Services.

Please review the information below carefully before accessing, downloading or using any of our Platforms, purchasing any Product or using our Services.

What Information Do We Collect?

Information We Collect from Registered Users. You may be required to register an account (“Account”) to purchase any Product or access any Service we provide. Once you’ve registered an Account, you’ll be referred to as a “Registered User.” We may ask for and collect the following information from a Registered User:

  • your name, e-mail address and age;
  • your IP address;
  • any information that you disclose when you make a purchase, such as Products purchased, prices paid, and the status of Products kept in your backpack (for example, unboxed or opened);
  • any information that you disclose when you engage with our Services including day/time when you log into your Account, use our Products, and interact with content on our Platform; and
  • If you signed up using a social login such as Google or Apple, we may receive your email address directly from such service.

What if I Don’t Register an Account? If you do not register an Account with us, you’re considered a “Visitor.” Visitors include those who simply wish to browse, search, and examine content and information on our Site. To see what information we collect from Visitors, please read Section 2(c) below.

Information We Collect from Both Registered Users and Visitors. When you visit our Site or use any of our Platforms, as either a Registered User or a Visitor, we collect:

  • any information that you provide or submit to us directly;
  • information you send to us by email, SMS, or any messaging services we engage with;
  • messages you send or post through our accounts on third party social networks (such as Discord, Telegram, Facebook, Instagram, YouTube, or Twitter);
  • domain names, IP addresses, and any information on pages you visit; and
  • information about your usage, such as pages you visit, the time and date of your activity on our Site or App, the frequency and size of data transfers, as well as information you display or click on. If you are logged into your Account, we may associate this information with your Account.

Cookies. We use “cookies” (small pieces of data we store for an extended period of time on your computer, mobile phone, or other device) provided through our analytics services to analyze the platform’s performance and improve our Services.

Surveys & Newsletters. We may now or in the future send or run surveys or provide newsletters to our Registered Users. At such time we may request certain identifying information such as name, email address, social media accounts, or other communication identifiers (such as Discord, WhatsApp, or Telegram).

Click-Through URLs. In some of our emails we may use a “click-through URL” linked to content on the Site or any of our other Platforms. When you click one of these URLs, they pass through our web server before arriving at the destination page. We may track this click-through data to help us determine interest in particular topics and measure the effectiveness of our communications.

Public Information on the Blockchains. Our Products are minted across multiple blockchains including Abstract and Polygon. We may collect data from activities that are publicly available on such blockchains. This may include blockchain addresses and information regarding purchases, sales, or transfers of our Products, which may then be associated with other data you provided to us. For example, we may use public blockchain data to verify that our Products are not traded on unauthorized exchanges or in violation of our Terms.

How Do We Use the Information You Provide Us?

We use any information collected, as described above, for the following purposes:

  • We may use your information to enable purchases of our Products and usage of our Services.
  • We may use your information to understand how you use our Services in order to improve and better personalize your experience on our Platform.
  • We may use your information to contact you to answer a question or address a concern that you've raised, or to provide customer service on your Account.
  • We may use your information to conduct research by sending you a survey.
  • We may use your information to send certain communications relating to your Account, such as service announcements and administrative messages.
  • We may use your information to send you marketing and promotional emails. You may opt-out of receiving commercial emails from us at any time by using the unsubscribe links provided in our emails.
  • We may use your information to improve the quality and design of the Platforms, Products, and Services and to create new features, promotions, functionality, and services.

Payment Information

Only Registered Users may make purchases of Products or pay for Services on our Platforms (together a “Purchase”). We use third parties to process payments and handle all chargebacks (the “Payment Processors”).

When making a Purchase, information such as your name, email address, Products and prices may be shared with our Payment Processors.

When a chargeback is requested, we need to share certain Purchase and activity details with the Payment Processors so they can handle the chargeback. This may also include information related to your IP address, device information and historical purchases.

Your interactions with our Payment Processors are governed by their own privacy policies. See Section 5(b).

If you used a credit card to pay for any Purchase on our Platform, your credit card account information may be subject to verification by the issuing credit card company or other third-party company.

We will not use any payment information related to your Purchase for any purpose except the fulfillment and record keeping of the transaction.

Do We Share Any of Your Personal Information with Others?

We do not sell, share, or rent personal information for the purposes of targeted advertising, as defined under applicable law. We have not engaged in such activities in the preceding 12 months. Without limiting the foregoing, we do not sell or share the personal information of minors under 18 years of age. Further, we will NEVER sell or share any of your personal information EXCEPT as specifically set below:

  • Some of our Products are produced under a license with commercial partners (“Licensed Products”). No personally identifiable information will be shared with partners.
  • We may share information collected with our agents, representatives, contractors, and third-party service providers so they can provide us with support services such as hosting, analytics, customer support, email and SMS delivery, payment services, and identity verification services.
  • We may share information with acquirers and other relevant participants in business transactions (or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale, or other disposition of all or any portion of the business or assets of, or equity interests in, Digitoys or our affiliates (including, in connection with a bankruptcy or similar proceedings).
  • We may also disclose your information when we determine in good faith that such disclosure is necessary to comply with applicable law or to cooperate with law enforcement.
  • We may share information as necessary with law enforcement, government authorities and private parties as we believe necessary to: (a) protect our, your, or others’ rights, privacy, safety, or property (including by making and defending legal claims); (b) enforce the terms and conditions that govern our Platforms, Products and Services; (c) process insurance requirements; and (d) protect, investigate, and deter against fraudulent, harmful, unauthorized, unethical, or any activity that may violate laws, regulations, our public representations, or our contractual obligations.
  • When you purchase, transfer, use, and manage any of our Products some personal data may be made publicly available on the blockchains. This may include blockchain addresses and information regarding your purchase, sale, or transfer of our Products.
  • Please do not share or provide any information with other users of our Platforms through any tools provided by or through our Platforms unless you’re prepared for any such information to be shared.
  • We use various third-party applications to help us better understand how people engage with our Site, Services, applications, and Platforms.

How Does Our Company Protect Your Personal Information?

We implement a variety of security measures to ensure the security of your information on our systems.

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. All information you submit to our Platforms is transmitted via Secure Socket Layer (SSL) technology.

When completing a paid transaction on our Platforms, your information is protected by our Payment Processors. Please review our Payment Processors’ policies:

  • On our Site:
    • Stripe, Inc.: Terms of Service and Privacy Policy
  • Within Mobile Applications (“Apps”): review any terms of service and privacy policy provided by Apple’s AppStore and Google Play at the time of purchase.

Please be aware that messages you send to us (whether by email, SMS, social media, or other systems) are not necessarily secure against interception and you should not include sensitive information in those messages. We generally will not ask for sensitive information in such communications and you should assume that if you get such a request, it might be fraudulent.

No method of transmission over the Internet, or method of electronic storage, is 100% secure, therefore, while we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security.

Third parties may unlawfully attempt to intercept or access transmissions or private communications. Although we work very hard to protect the privacy and security of your information, we do not promise, and you should not expect, that your personal information or private communications would always remain private.

Individuals Under 13 Years of Age

Pursuant to the provisions of the 1998 Federal Children’s Online Privacy Protection Act (“COPPA”), our policy is to refuse individuals under 13 years of age access to the Site, Platforms, Products, applications, and Services. We therefore do not knowingly collect personal information from individuals under 13 years of age.

How Long Do We Keep Your Information?

With regards to any personal information we collect directly from you, such as Account information, transaction data, and analytics, we retain such information for as long as necessary to provide our Products and Services and as required by law. The criteria we use to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide Services to you (for example, for as long as you have an Account with us or keep using our Services) and for twelve (12) months thereafter during which we may have a legitimate need to reference your Personal Information to address issues that may arise;
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or
  • Whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).

The above notwithstanding, as blockchain-based Products and Services, all transactions and other information recorded on the blockchain are permanent and publicly accessible.

Do-Not-Track and Global Privacy Control

The Site does not currently respond to browser “do not track” signals. Nonetheless, our Platform does recognize user enabled Global Privacy Control (“GPC”) signals. We will treat the GPC signal as either a Do Not Sell request or a request to limit the sale or sharing of personal information for targeted advertising depending on the law applicable to your jurisdiction. California Privacy Right

The California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), allows California residents to request access to the specific personal information that we collected about you, the categories of sources for that information, the business or commercial purposes for collecting the information, and the categories of third parties with which the information was shared.

California Civil Code Section 1798.83 allows users who are California residents to request certain information about the disclosure of their information to third parties for direct marketing purposes. We do not disclose users' data to third parties for direct marketing purposes. However, if you believe your data may have been sold in error and wish to contact us, please reach out to us using the information provided below.

Changes to Privacy Policy. If we decide to change our Privacy Policy, we will post those changes within this page and revise the "last updated" date at the top of the page. If there are material changes to the Privacy Policy, we will notify you either by prominently posting a notice of such changes before they take effect or by providing you with a notification directly. Be sure to review our Privacy Policy regularly so that you will be aware of any changes we make.
